Truck drivers in Texas with a bad accident history will not be able to find it as easy to get a new job at a new employer where they can cause more accidents. A new website has just been launched by the Federal Motor Carrier Safety Administration, and it will allow trucking companies access to constantly updated genuine accident data.
For a small fee, employers can now browse through five years of a driver’s accident history and three years of inspection records before they hire him. The data, which is currently being used by the federal agency, will allow employers plenty of information on which to base their choice. Trucking companies are required to register, and this can be done for free. After that, they have to pay a fee to access records Employers can expect to access records for a $10 fee for each record.
In my practice as a truck accident attorney in Houston, I frequently come across trucking companies who seem completely surprised when they learn that their driver has been involved in serious accidents before that they were not aware of. Hopefully, such cluelessness will be reduced now that trucking companies have access to truck driver accident records.
There is no pressure on trucking companies to use these records before hiring drivers, but obviously this will create a stronger filter to weed out unsafe drivers. It’s an opportunity that trucking companies must use.
