A report by the National Highway Traffic Safety Administration seems to indicate that airbag failures could have been a factor in hundreds of fatal accidents over the past few years. In fact, the television investigation conducted by Channel 4I, indicates that airbag systems might have failed in approximately 576 fatal accidents over a six-year period.
That may not seem like such a huge number. However, the study took only a small sampling of fatal accidents during that period of time, and also counted only those accidents that resulted in fatalities, not those that ended only in serious injuries. As a Houston injury lawyer, I am concerned that the actual number of such airbag failures in fatal accidents could be much higher than 576.
According to the study, between 2001 and 2006, there were 576 fatal accidents in which airbags failed to deploy. What’s worse is that in at least 360 of those fatal accidents, the NHTSA believes that the fatality could have been avoided if the airbag had deployed in time. The study relies on information obtained by the investigative team under the Freedom of Information Act, as well as a study by the Insurance Industry for Highway Safety.
As a Houston car accident attorney with a special interest in product liability issues, I would like the National Highway Traffic Safety Administration to conduct a thorough review and analysis of airbag failures and their role in fatal accidents. I think we will find that the actual numbers of such airbag failures is much higher than we know.
