Our Houston law firm has filed a lawsuit against Enterprise Products seeking an immediate Temporary Restraining Order (TRO) to require the company to preserve all evidence related to the cause and consequences of the February 8, 2011 explosion and fire at its natural gas facility in Mont Belvieu, Texas. We filed this litigation on behalf of some workers who hired us in connection with injuries they sustained as a result of the explosion.
We believe this action is necessary because the company has not been forthcoming regarding investigation activities at its facility, nor about the known consequences of the fire.
Concern that companies will not preserve material evidence is nothing new. For example, we have handled prior cases where big companies have “lost” critical evidence after a catastrophic event, which makes it more difficult for injured parties to make their case. For example, our attorneys recently discovered in litigation against Lyondell and Houston Refining that these companies failed to preserve equipment that failed at their facility which caused the massive May 17, 2010 fire at a chemical refinery near Pasadena, Texas.
Information has surfaced that the Mont Belvieu plant may have been having some problems in the days before this explosion, to the extent that plant supervisors were considering shutting down the facility. Our TRO lawsuit includes a request that the Judge order Enterprise Products to preserve all evidence related to those prior problems. This is important because we want to be able to investigate whether the prior problems contributed to cause the explosion, and if so, we want to investigate what the company knew about the prior problems and why the plant was not shut down before the explosion occurred.
