Toymaker Spin Master, which distributed the Aqua Craft Kit toys inside the United States, has agreed to pay $1.3 million in fines to the Consumer Product Safety Commission to settle allegations that the company continued to sell its Aqua Craft Kits even after receiving reports of injuries and illnesses.
The Aqua Craft Kits contain small beads that stick together when water is poured on them. The company soon began to receive reports of children who became severely ill after they ingested the tiny beads. At least two children went into a coma in October 2007. It was only after these two children fell so seriously ill, that the company announced a recall of more than 4 million craft kits.
According to the Consumer Product Safety Commission, the beads contain hazardous substances that convert to the date rape drug gamma hydroxybutyrate or GHB when ingested. The drug has been linked to a number of illnesses, including liver and kidney disorders. GHB can also damage the central nervous system.
The Consumer Product Safety Commission accuses Spin Master failing to inform the agency about the hazardous substances in the beads. The agency’s rules require manufacturers to inform the agency about any defects in a product within twenty-four hours of the manufacturer finding out about this defect. Spin Master however denies any wrongdoing, and says that it only agreed to pay the fines to settle the matter.
