Company to Pay $600,000 for Failure to Report Defective Toys



Build-A-Bear Workshop has agreed to pay $600,000 in penalties to federal safety regulators to settle charges that the company failed to report defects in its toy beach chairs.

The company will pay the money to the Consumer Product Safety Commission.  According to the allegations against the company, Build-A-Bear Workshop failed to notify the Consumer Product Safety Commission when it became aware of a defect in its product.  The defect involves sharp edges on the beach chair’s wooden frame.  The sharp edges can cause cuts, lacerations and other wounds.  They can even be severe enough to amputate a child’s fingertips.  The beach chairs were sold on the company’s website, and at Build-A-Bear stores between March 2001 and October 2008.

The Consumer Product Safety Commission insists that the company was aware of at least 10 reports of injuries that occurred between July 2007 and January 2009.  However, the company failed to report these incidents to the Consumer Product Safety Commission.  Under federal law, companies that become aware of a potential defect that involves a substantial product safety hazard, and could lead to an unreasonable risk of injury or death, must report this defect to the Consumer Product Safety Commission within a period of 24 hours.  These companies include manufacturers, retailers and distributors.

When products that are meant for little children contain defects, the risk of injuries is even higher than that involving products meant for adults because children may not be able to protect themselves from injuries, or even recognize a potential hazard.  That’s why manufacturers of children’s products must take special care to report defects immediately. .
