BMW Fined $3 Million for Not Reporting Safety Defects Immediately



The National Highway Traffic Safety Administration has fined automaker BMW $3 million for failure to report defects immediately, and failure to provide adequate information about safety defects.

According to the federal agency, it evaluated a total of 16 BMW recalls, including those for motorcycles as well as automobiles, since 2010 and found a number of instances where BMW did not report safety defects to the agency in time.  Under federal law, automakers who discover defects in their vehicles must report these to the federal agency immediately, or within 5 business days of discovering the defect.

As part of the settlement with the National Highway Traffic Safety Administration, BMW will pay $3 million in fines, and will also make internal changes to prevent such discrepancies in the future.  The company has said that BMW of North America and its parent company will make internal changes to its recall decision-making processes in order to ensure that future information is presented to the federal administration in a timely manner.

According to BMW, most of the recall filings that the National Highway Traffic Safety Administration had a problem with were related to motorcycles.  Only one was related to an auto recall.  The company says that even though some filings were delayed, the company did not hesitate to announce recalls in all the cases where defects were discovered.

That doesn’t comfort Houston defective product attorneys.  An auto recall needs to be prompt for it to be effective, and that can’t happen if automakers fail to provide the National Highway Traffic Safety Administration important safety information in time.
